Howard Kurtzberg was admitted to the New York State Bar, April 1983. He is a graduate of Benjamin N. Cardozo School of Law, New York, New York (J.D., 1982) and Queens College/City University of New York, Flushing, New York (B.A., 1979). Howard is a long time member of both the New York State Bar Association (Business Corporation and Real Property Law Sections) and the Nassau County Bar Association (Real Property Law Committee and Corporation Law Committee) and was inducted as a Fellow of American College of Investment Counsel (April, 1997) and remains a member in good standing.

Howard has been the subject of several biographical records in Strathmore's Who's Who Worldwide (2008); The Marquis Who’s Who in American Law (Tenth Edition 1998/1999; Twelfth Edition 2002/2003 and Fourteenth Edition 2005/2006); The Marquis Who’s Who in America (57th Edition published in 2002 and 58th Edition published in 2003); and The Marquis Who’s Who in the World 2002 (19th Edition published 2001).

Howard's practice includes representing NDH Capital Corporation (“NDH”) (see www.ndhcapital.com) in connection with the financing of promissory notes and other absolute unconditional payment obligations issued by limited partnerships, limited liability companies, major corporations, or governmental agencies as well as the sale and purchase of annuities and other payments secured by obligations of creditworthy companies. Howard has worked and continues to work extensively with major financial institutions (especially major insurance companies), real estate developers and syndicators, securities dealers, corporate borrowers (primarily including Fortune 1000 companies and utilities), utility companies, governmental agencies and their attorneys in connection with preparation and negotiation of financing documents and the closing of transactions. While many of the transactions involve investments in limited partnerships and limited liability companiess which have been formed to develop and/or operate affordable housing units, there are many other financing transactions and closings that he has been involved in with energy savings contracts and supply contracts.  In total Howard has closed hundreds of commercial loan transactions (approximately $3 billion in the aggregate). Howard has also acted as a consultant to major law firms in the preparation of private placement memoranda and other documents involving such limited partnerships and limited liability companies.

In addition to representing NDH, Howard's practice includes numerous commercial (office buildings, shopping centers) and residential (one, two and multi family houses, condominium and cooperative apartment units) real estate matters including representation of purchasers, sellers, mortgagees, mortgagors, landlords, and tenants (office leases, store leases, ground leases, 99 year leases, air rights, etc.)

Howard has been an approved residential mortgage closing attorney for: Bank of America; ABN AMRO Mortgage Group, Inc.; Chevy Chase Bank; Fremont Investment & Loan; GMAC Bank; Option One Mortgage Corporation; JP Morgan Chase Bank; and Wells Fargo Bank.  Howard previously handled residential mortgage closing attorney for Apple Bank For Savings (New York), where he closed hundreds of residential transactions, refinances, etc.).

Howard has been retained in connection with commercial and personal litigation matters, including personal injury and contract disputes. He has handle matters for small and large corporations and limited liability companies.

Howard has been involved and continues to be involved in the preparation of last will and testaments, health care proxies, living wills, and handles the probate and administration of estates.

Howard's prior experience includes collection matters for financial institutions and other entities (including successors in interest to the Resolution Trust Corporation); General Counsel for an investment banking/equipment lease finance company in Westbury, New York (transactions involved financing of equipment leases for major corporations, and the sale of loans from equipment lessors to financial institutions); Senior Associate for a Garden City law firm (closed a substantial volume of residential mortgage loans and commercial loans for major New York commercial and savings banks; experience also included drafting and reviewing commercial leases; drafting documents for commercial loan transactions, review and analysis of title reports and commitment letters as well as research of issues and preparation of complaints, motions and other litigation documents); Associate General Counsel for an investment banking company in New York, New York (transactions included sale of notes issued by partnerships, corporations or individuals, many of which were guaranteed by surety bond to financial institutions); and “in-house” attorney for Rose Associates, Inc., a real estate developer in New York, New York (responsibilities included representing the company in the sale of condominium apartments and cooperative apartment units; closing several hundred residential units and a number of commercial units; preparing amendments to offering plans; supervising another attorney and handling real property transfer gains tax procedures and refund applications).
